The granted planning permissions had a number of conditions, of those conditions, we are largely focused on the following, (which were phrased in 3 different ways on all 3 planning permissions granted by the council and clearly verify each other):

Then in 2006 a licensed business called Gilgamesh on the 1st floor began operating past midnight with a license that they applied for in breach of the conditions above

Then in 2010 an additional licensed business called Shaka Zulu began operating past midnight in the basement of Building C with a license that they applied for that also breached the conditions we are focusing on here

In 2018 Gilgamesh closed and vacated the 1st floor, and the owners have submitted a planning application just for that floor also with a license application, they propose to continue to breach the conditions above.

We wish those conditions applied fully to these applications, and Shaka Zulu, not to have persons in the building between midnight and 8am the next day to protect the neighbourhood after years of documented environmental damage by the occupants of Building C.

Shaka Zulu continue to operate in breach of conditions, and have been operating for 8 years, which is within the 10 year enforcement limitations. We want Shaka Zulu to comply with the condition not to have persons in the building between midnight and 8am the next day.

BUILDING C LICENSING

2018 License Application

The original license application was knowingly made for operational times that breached granted planning permissions. The 2001, 2003 and the final 2005 granted planning permissions, included above, for this building. All permissions specified strict conditions that no persons were to be in the building from midnight until 8am the next morning to safeguard the amenities of the adjoining premises and the area generally by preventing the building being used for loud or late entertainment, specifically to prevent it becoming a casino or night club.

This is the council's opportunity to correct and enforce the applicant to comply with the conditions of the granted planning permission for this building. To do so, the activity and times need to be significantly amended as suggested below.

To comply with planning conditions, licensing should not license operating times later than 23:30 (to allow minimal drink up time for the building to be emptied of customers and staff by midnight) then not to be occupied until 08:00 the next day.

Licensing should void the original Gilgamesh license and give the current landowners/occupants the option to reapply for a license that is compliant with planning conditions for that building.

A license review may be necessary to correct this.

A shadow license must not be granted for an unethical license that has deprived neighbouring residential amenity the protection they were prescribed by planning.

The operation of Gilgamesh on the 1st floor Building C has been the cause of severe environmental damage for residents in neighbouring Gilbeys Yard due to very poor management and the inappropriate structure of the building with a "soft top" retractable roof and very lightweight walls that could not contain noise within the building, in addition they allowed waste, mostly loud glass, to be stored and collected without permission on neighbouring land at anti social hours at the rear service door onto Gilbeys Yard Residential Estate, depriving many social housing residents the legal right to the quiet enjoyment of their homes, where many housebound disabled and young families, were sleep deprived. Children falling asleep in school because they had been woken 4/5/6am by anti social intoxicated Gilgamesh and Shaka Zulu customers, staff and glass waste collections into loud diesel hydraulic metal waste trucks. Which is exactly the behaviour that the planning conditions were meant to safeguard against, but were ignored by the landowners and their tenants in their license applications.

Building C (The Triangle Building, The Stables Market, Chalk Farm Road, London NW1 8AH) is not structurally capable of containing noise within itself. It does not have solid brick walls, it has very lightweight hollow walls and a canvas retractable roof. The use of this building for licensed entertainment is completely inappropriate and would be knowingly detrimenting neighbouring amenity of the adjoining premises and the area generally . Whether day or night, this building should not host loud activities of any sort, especially not amplified voice or audio, whether live or prerecorded and is best suited to the basic LABS office sharing environment alone with catering for those office folk. The events aspect that they are requesting with the use of retractable office walls to create an open event space under a retractable soft canvas roof, at any hours of the day, adds insult to injury with activity and times until 02:30am.

These businesses are prone to also use and abuse Temporary Event Notices (TENs) to get even later licensed times than the excessive licensed hours they had.

With Gilgamesh and Shaka Zulu the residents suffered terrible noise levels until 3 or 4am with extremely loud intoxicated preloaded customer arrivals and then worse later departures, without even providing the marshals / security staff prescribed in their license conditions. After their loud customers and staff departed 2 - 4am there would be hours of careless cleanup staff moving a lot of glass from all the alcohol consumed, until 5 to 6am, when even louder metal hydraulic diesel waste trucks would rumble and clatter through Gilbeys Yard or Morrisons car park with reverse alarms to smash into them all that licensed glass, for half an hour at time. Then maybe the residents could get a few hours sleep around 6:30am before school or work.

Does this sound like a license that should be shadowed or voided to satisfy our licensing objectives?

TOTAL DISREGARD FOR THE MAJOR WASTE ISSUE CAUSED BY CAMDEN MARKET

The plan drawing document "Floor plan.pdf" provided with this license application APP\PREMISES-NEW\090507 puts "WASTE STORAGE" on neighbouring land when they have been told that they cannot use the land in this way especially after documented historic disturbance caused by its mismanagement

The position they have indicated is not on their land nor do they have permission for using the land especially as waste storage and collection which caused severe environmental issues for neighbouring amenity historically when they did it without permission, they have specifically been told they cannot use this land for waste storage or collection by landowners.

Camden Council Planning enforced the takedown of their makeshift waste storage shed here numerous times in recent years as reported HERE
